1. DEFINITIONS AND INTERPRETATION

  • "User", "You", "Your": Refers to any natural or legal person who browses, accesses, creates an account, or transacts on the Platform.
  • "Swatik Store", "We", "Us", "Our", "Company": Refers to the corporate entity owning the brand Swatik Store, its subsidiaries, affiliates, directors, and authorized representatives.
  • "Platform": Includes the website URL, mobile applications (iOS and Android), mobile website, and any associated API or interfaces owned by the Company.
  • "Agreement": Refers collectively to these Terms and Conditions, the Privacy Policy, the Return and Refund Policy, and any other specific guidelines posted on the Platform.

2. ACCOUNT REGISTRATION, SECURITY, AND ELIGIBILITY

  • 2.1 Age Restriction: Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including minors, un-discharged insolvents, etc., are not eligible to use the Platform. If you are a minor (under the age of 18 years), you shall not register as a User and shall not transact on the Platform unless supervised by a legal guardian or parent.
  • 2.2 Account Accuracy: You agree that any details you provide to us during registration, checkout, or guest access are true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, or incomplete, or if Swatik Store has reasonable grounds to suspect such information is false, we reserve the right to indefinitely suspend, terminate, or block your access.
  • 2.3 Password Security: You are entirely responsible for maintaining the strict confidentiality of your account credentials (ID and password). You agree to immediately notify Swatik Store of any unauthorized use of your account or any other breach of security.
  • 2.4 Multi-Account Abuse: Users are prohibited from creating multiple accounts to exploit promotional codes, loyalty bonuses, wallet cash, or purchase limits. Swatik Store reserves the right to merge or terminate accounts found violating this clause.

3. COMMUNICATIONS AND ELECTRONIC CONSENT

  • 3.1 Consent to Electronic Data: When you visit the Platform, send emails, or submit queries, you are communicating with us electronically. You consent to receive all operational, transactional, commercial, and promotional communications from us electronically.
  • 3.2 Channels of Communication: Communications may be transmitted via email, short message service (SMS), WhatsApp, push notifications, automated telephonic interactive voice response (IVR) calls, or by posting notices on the Platform interface.
  • 3.3 Opt-Out Limitations: You may unsubscribe from promotional marketing lists at any time via the "Unsubscribe" link. However, you cannot opt out of critical transactional notices, shipping updates, legal amendments, or security alerts.

4. PRODUCT SPECIFICATIONS, PRICING, AND AVAILABILITY

  • 4.1 Visual and Description Disclaimers: Swatik Store attempts to be as accurate as possible in product descriptions, imagery, and specifications. However, we do not warrant that product descriptions, colours, dimensions, weights, or other content on the Platform are completely error-free. The actual visual attributes you perceive depend entirely on your display hardware configuration.
  • 4.2 Pricing Typographical Errors: While Swatik Store strives to provide exact pricing data, clerical, systemic, or typographical errors may occur. If a product is listed at an incorrect price or with incorrect promotional information, Swatik Store retains the absolute right, at its sole discretion, to refuse or cancel any orders placed for that product, regardless of whether the order has been confirmed or your payment method has been charged.
  • 4.3 Price Fluidity: Prices for items are dynamic and subject to structural change without prior notification. These changes may be driven by market conditions, supply chain costs, raw material fluctuations, or promotional cycles.
  • 4.4 Inventory Caps and Limitations: Swatik Store reserves the right, without prior notice, to limit the order quantity on any item and/or to refuse service to any customer. We may restrict orders placed by the same account, the same credit card, or orders that use the same billing and/or shipping address to prevent commercial re-selling.

5. TAXES AND INVOICING

  • 5.1 Statutory Compliances: All commercial transactions on the Platform are subject to statutory taxes as mandated by the Government of India. The prices displayed for items are inclusive of Goods and Services Tax (GST), Central GST (CGST), State GST (SGST), and Integrated GST (IGST), unless explicitly broken down otherwise during the checkout sequence.
  • 5.2 Invoice Generation: A comprehensive commercial tax invoice will be generated and electronically delivered alongside your shipping confirmation or inside the physical package. The invoice details will precisely reflect the billing data you provided at the moment of order finalization. No retrospective modifications to invoices (such as appending a corporate GSTIN after order placement) will be entertained.

6. PLATFORM USAGE, USER CONDUCT, AND RESTRICTIONSYou strictly agree, undertake, and covenant that your utilization of the Platform shall be strictly governed by the following binding conduct directives. You shall not host, display, upload, modify, publish, transmit, update, or share any data or information that:

  • 6.1 Third-Party Rights: Belongs to another person and to which you do not have any legal right or title.
  • 6.2 Harmful Content: Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever.
  • 6.3 Intellectual Property Theft: Infringes any patent, trademark, copyright, trade secret, or other proprietary rights of Swatik Store or any external third party.
  • 6.4 Malware Transmission: Contains software viruses, trojan horses, worms, time-bombs, cancelbots, easter eggs, or any other computer programming routines, files, or programs designed to interrupt, destroy, limit, or corrupt the functionality of any computer resource.
  • 6.5 Cyber Warfare and Data Scraping: Attempts to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any Swatik Store server, by hacking, password "mining," or any other illegitimate means. You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm, or methodology to access, acquire, copy, or monitor any portion of the Platform.

7. PAYMENT SERVICES, GATEWAYS, AND CASH ON DELIVERY (COD)

  • 7.1 Third-Party Processing: Swatik Store utilizes specialized, RBI-authorized, secure third-party payment gateways, aggregators, and networks to process payments.
  • 7.2 Limitation of Liability for Failures: Swatik Store shall not be held liable or responsible for any financial loss, emotional distress, or operational delay caused by:

    • Lack of authorization for any specific transaction.
    • Exceeding the preset credit/debit limits mutually agreed between you and your issuing banking institution.
    • Systemic technical glitches, timeouts, or network dropped connections occurring within the bank or payment gateway infrastructure.
    • Decline of transactions arising out of suspected fraudulent or high-risk profiles.
  • 7.3 Cash on Delivery (COD) Rules: COD facilities are granted as a privilege, not a structural right. Swatik Store reserves the categorical right to disable COD options for specific zip codes, high-value orders, or accounts showing historical patterns of order rejection at the doorstep.

8. LOGISTICS, DELIVERY, RISK OF LOSS, AND TITLE

  • 8.1 Third-Party Couriers: Logistics operations are handled by independent third-party courier services and freight networks. Any delivery timelines shown on the checkout portal are purely statistical estimates and do not represent a definitive contractual deadline.
  • 8.2 Jurisdictional and Geographic Limits: Delivery will be attempted only to physical addresses within the defined delivery network mapped inside our system. We do not ship to P.O. Boxes or military APO/FPO addresses.
  • 8.3 Risk of Loss and Legal Title: All items purchased from Swatik Store are manufactured and shipped pursuant to a strict shipment/carriage contract. The risk of loss, damage, and legal title for such physical merchandise pass directly to you the moment we hand over the shipment to the carrier. However, physically damaged items or shipping missing boxes remain subject to resolution under our designated Return Framework.

9. CANCELLATION, RETURN, REPLACEMENT, AND REFUND POLICY

  • 9.1 Pre-Shipment Cancellation: You may cancel an order free of cost at any time before the product status transitions to "Shipped" or "Dispatched" inside your user dashboard. Once dispatched, cancellation requests cannot be structurally processed via the frontend platform.
  • 9.2 The Inspection Window: Upon receipt of the package, you must physically inspect the structural integrity of the outer shipping box. If the box is structurally ruptured, crushed, or open, do not accept the package from the courier agent.
  • 9.3 Return Parameters: Swatik Store offers a [7/14/30] day return/replacement window from the date of physical delivery. Returns are strictly contingent upon the item being in its pristine, pristine-original condition, unused, unwashed, with all tracking tags, serial numbers, labels, original boxes, and product manuals fully intact.
  • 9.4 Non-Returnable Categories: Specific product verticals are strictly non-returnable due to hygiene, safety, or consumable expiry frameworks (e.g., personal care, cosmetics, innerwear, custom-tailored merchandise, or downloadable digital items).
  • 9.5 Refund Pipelines: Once a returned product reaches our fulfillment center, it undergoes strict quality validation. Approved refunds are routed directly back into the exact financial channel utilized during the original transaction (Credit Card, Debit Card, Net Banking, UPI, or designated Wallet). Refunds take approximately 5 to 7 operational banking business days to post into your account.

10. INTELLECTUAL PROPERTY RIGHTS & PROPRIETARY CONTENT

  • 10.1 Exclusive Ownership: All structural components, digital assets, and literary content hosted on the Platform—including but not limited to source code, object code, database architectures, graphics, text layouts, user interfaces, photographs, custom icons, audio files, video materials, brand names, and the "look and feel" of Swatik Store—are the exclusive intellectual property of the Company and are protected by Indian and International Copyright, Trademark, Patent, and Trade Secret statutes.
  • 10.2 Strict Prohibition: You are expressly forbidden from downloading, copying, replicating, reverse-engineering, decompiling, scraping, distributing, altering, or creating derivative works from any component of the Platform's proprietary material without securing an explicit, physical, written licensing framework signed by an authorized corporate officer of Swatik Store.

11. INTELLECTUAL PROPERTY INFRINGEMENT CLAIMSSwatik Store respects the intellectual property rights of creators. If you believe that your proprietary copyright or trademark has been unlawfully duplicated or displayed on our Platform, you must submit a formal Infringement Notice to our legal desk containing:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
  • A comprehensive description of the copyrighted work that you claim has been infringed.
  • The specific URL/location on our Platform where the alleged infringing material is located.
  • Your complete contact information (Address, Phone Number, and Email).

12. THIRD-PARTY LINKS AND EXTERNAL SERVICESThe Platform may contain links to external web assets, payment aggregators, analytics providers, or social media networks operated by independent third parties. Swatik Store exercises zero administrative or operational control over these third-party platforms. We do not endorse, evaluate, or warrant the contents, privacy compliance, security protocols, or performance of external entities, and you access them entirely at your own financial and security risk.13. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

  • 13.1 "As-Is" Provision: THIS PLATFORM, ALL FUNCTIONAL SERVICE INFRASTRUCTURES, AND ALL PHYSICAL PRODUCTS TRANSFERS MADE AVAILABLE TO YOU THROUGH THIS PLATFORM ARE PROVIDED BY SWATIK STORE ON AN "AS IS" AND "AS AVAILABLE" STRUCTURAL BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.
  • 13.2 Complete Warranty Exclusion: TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, SWATIK STORE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVERS, CODES, APIS, OR ELECTRONIC UTILITIES TRANSMITTED FROM OUR DATA HUBS ARE FREE OF MALICIOUS CODE, SYSTEM VIRUSES, OR TROJAN ATTACKS.
  • 13.3 Liability Cap: IN NO EVENT SHALL SWATIK STORE, ITS PARENT ENTITY, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PLATFORM. THE MAXIMUM AGGREGATE FINANCIAL LIABILITY OF SWATIK STORE UNDER ALL CLAIMS SHALL BE STRICTLY LIMITED TO THE EXACT MONETARY AMOUNT RECEIVED BY THE COMPANY FOR THE SPECIFIC ORDER GIVING RISE TO THE DISPUTE.

14. INDEMNIFICATION AND RELEASEYou agree to indemnify, defend, and hold completely harmless Swatik Store, its parent corporation, corporate affiliates, officers, directors, stakeholders, employees, and third-party partners from and against any and all claims, liabilities, damages, losses, costs, expenses, legal fees, or administrative penalties initiated by any third party arising out of, or resulting from:

  • Your explicit breach or violation of these Terms and Conditions.
  • Your violation of any applicable territorial laws, rules, or data privacy guidelines.
  • Any malicious input, data corruption, or fraudulent activity executed via your user profile.

15. TERM, TERMINATION, AND ACCOUNT DEACTIVATION

  • 15.1 Continuous Horizon: This Agreement shall remain in full force and effect so long as you utilize or access any structural component of the Platform.
  • 15.2 Right to Terminate: Swatik Store reserves the absolute right, without liability or prior notification, to unilaterally terminate, restrict, suspend, or delete your account if we discover or suspect that you have violated these Terms, engaged in fraudulent activities, or engaged in behavior detrimental to the platform's commercial environment.
  • 15.3 Survival Clauses: All provisions which by their inherent nature are meant to survive termination shall survive, including Section 10 (Intellectual Property), Section 13 (Limitation of Liability), Section 14 (Indemnification), Section 16 (Governing Law), and Section 17 (Arbitration).

16. GOVERNING LAW AND JURISDICTIONThese Terms of Service, the entire commercial contract framework, and any extra-contractual obligations or claims arising out of or in connection with them shall be exclusively governed by, construed, and interpreted in strict accordance with the laws of the Republic of India. You unconditionally and irrevocably agree that the competent courts located in [Insert City Name, e.g., Mumbai/Delhi/Bengaluru], India, shall possess exclusive territorial and subject-matter jurisdiction over any legal suit, action, or proceeding.17. ARBITRATION AND DISPUTE RESOLUTION

The arbitral tribunal shall consist of a sole arbitrator mutually appointed by both parties. The seat and venue of the arbitration shall be [Insert City Name], India. 18. SEVERABILITY, WAIVER, AND AMENDMENTS

All updates will be signaled by updating the "Last Updated" timestamp at the top of this page. Your continued use of the platform post-publication represents an absolute confirmation of your acceptance of the updated terms.

19. FORCE MAJEURESwatik Store shall not be held liable, penalized, or deemed in default for any failure or delay in the performance of its operational obligations under this contract resulting from events beyond its reasonable control, including but not limited to: acts of God, earthquakes, floods, fires, severe weather anomalies, pandemics, epidemics, lockdowns, grid failures, cyber-warfare, server node structural crashes, internet backbone disruptions, labor strikes, civil unrest, acts of terrorism, war, or drastic regulatory shifts by state or federal administrations.20. GRIEVANCE REDRESSAL MECHANISM & CUSTOMER SUPPORTIn strict compliance with the Information Technology Act, 2000, Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020, the name and official contact protocols of the Grievance Officer assigned to Swatik Store are listed below. All consumer grievances, technical issues, or complaints must be formally routed here:
